Terms of Service
I wish to ensure there is clarity and transparency in our commitments to each other in order to ensure that you and others have a positive experience of my events. To enable this, I kindly request that you comply with these Terms of Service. Please read them carefully before you book as they provide you with the information on how I will provide the services, payment terms, cancellation terms, and other important information.
Definitions
“Event” means any single or multi-session event offered on this website.
“You” means the person or organisation who books an event.
Agreement
By submitting an application form or making a booking you are signifying your agreement to and acceptance of these Terms of Service.
These Terms of Service may change from time to time, and the latest version will appear on this website.
Payment Terms & Cancellation
Once You have made an application or booking you will be requested to pay the amount due. Your place is not booked, until payment is received and you have received email confirmation that you have been accepted on to the event.
If you wish to cancel a booking, do so no later than 2 weeks prior to the event if you wish to qualify for a full refund. Unfortunately a refund cannot be provided if you cancel with less than 2 weeks' notice. The fee can however be transferred to a future event.
If, once You have started a course/event, you are unable to complete it due to unforeseen circumstances, I can defer your place to a future course/event.
If for any reason I have to cancel a course or other event you are booked on, I will refund you in full. I will endeavour to let you know as soon as possible. Alternatively, I may ask you if you would like to transfer your payment to a future event if one is available.
Requirements, Attendance and Conduct
You must advise us at the time of making your application if You have any specific needs so that we can contact you to discuss your requirements.
You must be at least 18 years of age to attend any of my events., unless accompanied by an adult.
If an event is being delivered online You must have access to a computer or laptop with a webcam, have good broadband, and be capable of running Zoom or Teams.
You must ensure that you comply with all health and safety, licensing and other rules and regulations of the venue or applicable to the venue. It is your responsibility to familiarise yourself with any rules and regulations that apply.
You are expected to behave respectfully and politely throughout any event. I reserve the right, at our sole discretion, to ask you to leave an event if your behaviour is deemed to be disruptive in any way and you agree to do so immediately. In such circumstances no transfer, refund or forward credit will be given.
Liability
By applying for a course/event, you assume responsibility for ensuring you are physically and psychologically fit to participate and that you have consulted with your doctor or psychologist as necessary. Whilst no judgement is made as to your fitness to participate, you should inform me privately of any personal concerns that may arise as the course/event progresses. If for any reason I find it necessary to ask you to stop doing the course/event then you agree to do so immediately. In such circumstances a refund, minus the proportion of course/event attended.
Some of the activities undertaken on the events are movement or floor based. It is always your responsibility to make a decision about whether to participate to take part in a particular activity. If there is any doubt, the decision should always be to exercise caution and I recommend that you consult a doctor or health professional if you are ever unsure whether an activity is safe for you.
None of my events are intended to be a substitute for counselling, psychotherapy or on-going medical advice from a qualified medical practitioner and subject to this clause we exclude any liability relating to any statement or representation made in respect of the therapeutic, psychological or medical benefits of my services. Any unresolved issues which may surface for you and which may warrant medical treatment, counselling or psychotherapy will be at your own risk and expense.
You attend and participate in a course/event at your own risk. I accept no liability for:
any costs or expenses arising out of or in connection with any event,
loss or damage to personal property
personal injury, except as set out below.
loss of data, profit, revenue, use, business, anticipated savings, goodwill, reputation or opportunity, financial or economic loss or any indirect or consequential loss or damage
Liability is specifically excluded in respect of any dietary, health or other special requirements. If You have a specific requirement, please contact the venue directly in advance to ensure they can accommodate You and make Your requirements known to the venue on your arrival.
To the extent permitted by law I exclude all warranties, conditions, representations or other terms whether expressed or implied.
I shall not be responsible for any loss or damage, whether in contract or in tort (including negligence), that is beyond my foreseeable control.
Confidentiality
I take the confidentiality of those who come to our events and those who work with us very seriously. I am under obligation to keep your information confidential (except as otherwise required by law), however I have a Safeguarding Policy and in exceptional circumstances, where there is risk of harm, I may share information. Please refer to the Safeguarding Policy on this website:
From time to time, participants at a course/event may share sensitive information. I expect you to treat any information shared as confidential. I reserve the right to ask you to leave a course/event if such information is shared inappropriately, and you agree to do so immediately. In such circumstance no transfer, refund or forward credit will be given.
Intellectual Property
At all times, I will retain ownership of all intellectual property in relation to this website, my events and any other services provided, including all training materials. Use of these services does not give you any ownership on the service, its content or any trademarks or logos used.
Material (including recordings) on my website or made available at course/events cannot be amended, adapted, copied, republished, translated, disseminated, made available distributed in any way without our specific permission.
Force Majeure
I will not be liable for any failure or delay in the delivery of an event which is caused by circumstances beyond its reasonable control, including but not limited to strike, lock-out, labour disputes, acts of Gods, acts of terrorism, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, insolvency or bankruptcy of either party or any third party, fire, flood, snow and storm, exceptional weather conditions, difficulty or increased cost in obtaining workers, goods or transport and other circumstances affecting the supply of goods or services.
Severance
Each of the paragraphs of these Terms of Service operate separately. If any court or relevant authority decided that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
No Waiver
The failure by either you or myself to enforce any obligation under these Terms of Service at any time or for any period shall not be considered a waiver of the either party’s rights at any time subsequent to insist upon enforcing that term or any other term of these Terms of Service.
Entire Agreement
These Terms of Service are the entire Agreement between parties and supersede all prior agreements and understandings, whether implied, written or oral, between the parties.
Complaints
I always aim to provide a high standard of care in all our services. If you are unhappy with any services, it is important that you let me know so I can address the issue and improve standards wherever possible. I will take any complaints seriously and aim to respond promptly, fairly and effectively.
Law and Jurisdiction
These Terms of Service are governed by English law. This means the Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Both parties agree that the courts of England will have exclusive jurisdiction.
